1. About these terms

These terms cover the public website at www.logitm8.com, operated by Day 4 Tech Pty Ltd (“we”, “us” or “our”), including public information, demonstrations, calculators and enquiry forms.

Subscriptions to LogITm8 and PressureLog are governed by the Subscription Terms accepted when subscribing. Separate pilot agreements govern pilot participation. These Website Terms do not change those agreements or reduce rights under them.

Browsing the website, making an enquiry or requesting a demonstration does not start a paid subscription.

2. Website information

We aim to keep website information accurate and current. Product descriptions, examples and demonstrations explain the service but may not show every feature, limitation or configuration.

PressureLog records information supplied by users. It does not perform physical tests, verify readings or equipment calibration, or determine whether work meets legal, engineering, safety or customer requirements. References to compliance records or audit preparation do not mean that PressureLog certifies work or guarantees acceptance by an auditor or regulator.

General website information is not advice about the requirements of a particular job. Nothing in these terms excuses misleading information or removes responsibility that cannot lawfully be excluded.

3. Demonstrations, calculators and estimates

Demonstrations and sample reports illustrate how the service works. Use fictional or suitably de-identified information in public demonstrations unless we have expressly arranged otherwise.

Calculator outputs and estimates depend on the inputs and assumptions used. Estimated time savings, cost savings or business benefits are illustrative and are not a guarantee of your results. Actual outcomes depend on your business, existing processes, usage and other circumstances.

Consider the assumptions and limitations accompanying an estimate before relying on it. A calculator output is not a personalised quotation or a commitment to deliver a particular financial outcome.

Applicable subscription prices, inclusions and billing arrangements are disclosed when you select and accept a plan.

4. Permitted use and intellectual property

We or our licensors own the website’s software, branding, text, graphics, designs and other protected material.

You may view the website and download or print reasonable extracts for evaluating our services or for your internal business reference. Keep ownership notices intact and do not present the material as your own.

Except where permitted by law or with our written permission, you must not reproduce substantial website content for commercial distribution, resell it or use our branding in a way that suggests an endorsement or affiliation.

You may link to publicly accessible pages fairly and lawfully, without implying our approval or presenting our content as your own.

5. Misuse and access restrictions

You must not use the website unlawfully, introduce malicious software, attempt unauthorised access, interfere with its operation, or collect information through methods that bypass access controls or materially disrupt the website.

We may restrict access where reasonably necessary to address misuse, security threats or legal requirements. Restrictions affecting a subscribed service remain subject to the applicable Subscription Terms.

6. Enquiries and information you submit

Provide accurate contact information and submit only material you are authorised to share. Avoid including sensitive personal information, payment-card details or confidential job records in public enquiry forms.

We may use information you submit to respond to your enquiry, arrange a demonstration and take steps you request, as explained in our Privacy Policy. Submitting an enquiry does not give us ownership of your material or permission to publish it.

An enquiry alone does not constitute consent to unrelated marketing.

7. Privacy and website storage

Our Privacy Policy explains how we collect, use, disclose and retain personal information, including overseas processing and how to contact us about privacy.

We do not use website analytics, advertising cookies or other non-essential tracking. Necessary technologies may support functions such as authentication, security and service operation. Any device storage used by the application is explained in the applicable privacy and data-handling information.

8. External links

The website may link to third-party websites or resources. Those operators control their own content, services and privacy practices. A link does not, by itself, mean we endorse everything on that website.

Review the relevant third party’s terms before using its services. This clause does not exclude responsibility for our own conduct.

9. Availability and changes

We may update the public website, correct errors or temporarily interrupt access for maintenance or security. We do not promise uninterrupted public website access.

Changes to public website content do not retrospectively change an accepted subscription, quotation or pilot agreement.

We will identify the effective date of updated Website Terms when publishing them. Updates apply prospectively and do not remove rights relating to earlier events.

10. Liability and statutory rights

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Subject to those rights, and to the maximum extent permitted by law, Day 4 Tech Pty Ltd excludes financial liability arising from your use of, or inability to access, the public website, including loss of profit, revenue, business opportunity or data.

This exclusion does not apply to fraud, wilful misconduct or liability that cannot lawfully be excluded. It does not alter our obligations under an accepted subscription, pilot agreement or other separate agreement.

These terms do not require you to indemnify us or waive non-excludable rights.

11. Governing law and contact

Queensland law governs these terms. The parties submit to the non-exclusive jurisdiction of Queensland courts and courts hearing appeals from them, without limiting any mandatory right to bring proceedings elsewhere.

If a provision is unenforceable, the remaining provisions continue to the extent they can operate independently.
